Sybil Newton and Scott Stevens obtained a favorable ruling from the Florida First District Court of Appeals affirming summary judgment on behalf of their client – a condominium association – on claims that the association’s board of directors exceeded their statutory authority in participating in collateral litigation and levying special assessments arising from the litigation. The Circuit Court of Walton County granted summary judgment in favor of the association and thereafter denied a motion for rehearing on the summary judgment. The appellate court affirmed the summary judgment in favor of the association and also awarded the association its attorney’s fees related to the appeal.
