Before the Alabama Court of Civil Appeals, Tony Davis, Richard Davis, and Amber Whillock defeated yet another challenge to a National Pollution Discharge Elimination System (NPDES) permit issued to a surface mining client by the Alabama Department of Environmental Management (ADEM), when the Court entered an order of affirmance on March 15, 2013. The permit had previously been affirmed after a three-day contested administrative hearing before a hearing officer and then subsequently affirmed in turn by the Alabama Environmental Management Commission and the Montgomery County Circuit Court after hearings.
