Mike Wright and John McCall secured a defense verdict for a reproductive endocrinologist in a wrongful death claim filed by a mother in connection with the loss of her unborn child. The claim involved a dilatation and curettage procedure performed upon the mother at a time in which a molar/ectopic pregnancy versus early miscarriage was suspected. Five days after the procedure was completed, a gestation was visualized by ultrasound at another physician’s office. The pregnancy miscarried two months later. The plaintiff claimed that the dilatation and curettage procedure caused incompetent cervix that ultimately resulted in the loss of the pregnancy. The trial lasted five days and resulted in a defense verdict.
