Scott Salter and Billy Bates obtained a defense verdict on December 6, 2013, in favor of a psychiatrist in a wrongful death action in Federal Court in the Northern District of Alabama. The decedent died from cardiac arrest subsequent to electroconvulsive therapy treatment. The plaintiff alleged that the psychiatrist failed to properly obtain informed consent, failed to obtain proper clearance from specialists based on the decedent’s medical conditions, and failed to properly run recovery efforts when the decedent’s conditions deteriorated. Following a week long trial in which eleven witnesses, eight of whom were physicians, testified, the jury returned a verdict in favor of the defendant psychiatrist.
