Jeannie Walston and Ben Presley secured a summary judgment for 4 supervisory co-employees in a case where the plaintiff was seriously injured after falling 7 feet while operating a mud car at a coke plant. The plaintiff alleged that the man lift on the mud car failed and that the 4 co-employees who supervised employees in charge of the mechanical and electrical aspects of the mud car were negligent by failing to maintain and inspect the car. The trial court disagreed and held that they were not negligent and dismissed them from the lawsuit. The case remains pending against the third party company who contracted with the coke plant to inspect and maintain the wire rope on the man lift.
