Mike Wright recently secured the dismissal of two gastroenterologists and a hospitalist during trial for wrongful death that was tried to verdict in Jefferson County, Alabama. The case proceeded against a co-defendant surgeon and hospital. The hospital settled at the close of its case, and verdict was returned against the surgeon after twelve days of trial for $3 million. The case involved the death of a patient with multiple co-morbidities for whom cholecystectomy was indicated but not accomplished over three different hospital admissions. Plaintiff alleged that each defendant physician failed to recognize the severity of the patient’s gallbladder condition and need for urgent surgery, which plaintiff contended ultimately resulted in a septic death of the patient.
