Mike Wright and Michael Scivley obtained a defense verdict in favor of a general surgeon in a case involving laparoscopic cholecystectomy which resulted in a complete transection of the common bile duct. The plaintiff presented expert testimony in support of her theory that the surgery was negligently performed and the injury was caused by surgeon error. The defense presented expert testimony that the surgery was performed within the standard of care and the injury was the result of deceptive anatomical variation which was imperceptible to the surgeon, despite due care and reasonable judgment. After a five day jury trial, a verdict was returned in favor of the defense following brief deliberation.
