Starnes attorneys Joe Miller and Joseph Reese obtained a defense verdict for an electrophysiologist in a case alleging negligent recommendation of an ablation procedure, and negligent failure to obtain informed consent, regarding a patient with atrial fibrillation. The Plaintiff unfortunately suffered an atrio-esophageal fistula (connection between esophagus and heart) due to the procedure, resulting in several strokes, sepsis, risky corrective surgery, and a lengthy recovery. The Plaintiff claimed damages for permanent neurological deficits, among other things. After a six-day trial involving nine witnesses, the jury returned a verdict on behalf of the defendant physician.
