Michael Scivley and Mike Wright recently won an appeal before the Supreme Court of Alabama in a medical malpractice lawsuit against a neurosurgeon. The plaintiff claimed the defendant breached the standard of care in relation to postoperative complications following a neurological surgery, which allegedly injured the plaintiff. The defendant moved for summary judgment on the basis that the plaintiff failed to prove through substantial evidence that he breached the standard of care or that the alleged injury was probably caused by a negligent act or omission. The trial court granted the motion following a hearing. On appeal, the Court affirmed the judgment.
