Chris Eagan, Sybil Newton, Todd Huntley, and Averie Armstead Jones obtained a favorable ruling from the Alabama Supreme Court affirming summary judgment in a medical malpractice case. The plaintiffs asserted that claims regarding surgical techniques and post-operative care by a board-certified GYN-Oncologist did not require testimony from an independent expert and also argued that the defendant’s testimony sufficed to establish a breach of the standard of care. In essence, the plaintiffs sought to expand the law in Alabama governing the narrow exceptions to the expert requirement under the Alabama Medical Liability Act. The Alabama Supreme Court rejected the plaintiffs’ arguments and affirmed the judgment in favor of the defendant without opinion, upholding the trial court’s ruling that the case could not proceed without proper expert support.
