Starnes attorneys, Scott Stevens, Sybil Newton, and Amber Whillock secured a favorable written opinion from Florida’s First District Court of Appeal, affirming dismissal of claims against our client for malicious prosecution and civil conspiracy. The appellate court held that the trial court properly dismissed the malicious prosecution claim, with prejudice, since plaintiffs could not demonstrate that they prevailed on all counts in the underlying litigation. The appellate court further held that the civil conspiracy claim was properly dismissed since it was not permitted as a freestanding tort claim.
