Trip Umbach and Breanna Young obtained a defense verdict on April 30, 2014, in favor of a trucking company in a race discrimination and retaliation action in Federal Court in the Northern District of Alabama. The employer terminated the African American plaintiff and his White co-worker at the same time for failing to perform their job duties. The plaintiff alleged that he was terminated because of his race and because he had previously complained about his co-workers’ use of racial slurs in violation of Title VII and 42 U.S.C. § 1981. Following a three-day trial in which nine witnesses testified, the jury returned a verdict in favor of the employer on all counts.
