Joseph Reese and Joe Miller obtained a jury verdict for a general surgeon following a one week trial in Birmingham. The plaintiff alleged the surgeon negligently performed a gallbladder removal surgery, causing a bile duct injury, and then failed to timely and properly respond to that injury. At the conclusion of the trial, the jury returned a defense verdict based on evidence that such an injury is a recognized complication associated with gallbladder surgery, the surgeon followed appropriate technique in performing the surgery, and his actions in addressing the complication were both reasonable and timely.
