Chris Eagan and Randy Sellers obtained a defense verdict for an emergency room physician in a wrongful death case in Calhoun County Alabama. The case involved a patient treated in the emergency room on Christmas day 2009 where he was discharged with a diagnosis of constipation. Three days later he went to another ER with signs and symptoms of a small bowel obstruction and was transferred to another hospital where he died from a bowel perforation. The plaintiff claimed the standard of care required a CT scan instead of a plain x-ray to rule out small bowel obstruction. Plaintiff also claimed the discharge instructions were inadequate even though the physician instructed the patient and his family to return if worse. Following a week long trial, the jury returned a verdict for the defendant emergency physician.
