President Trump Bans DEI
Shortly after taking office, President Trump rescinded many of President Biden’s Executive Orders and issued several new Executive Orders seeking to ban all diversity, equity, inclusion, and accessibility programs, policies, and initiatives. His Orders are far-reaching. They impact private employers, educational institutions, federal government contractors, and any individual or entity making any kind of certification of compliance with law or regulation to the government, including those made under penalty of law or of perjury (implicating the False Claims Act and federal criminal law). One of his Executive Orders requires the identification of large organizations considered to be the most egregious offenders for potential litigation and enforcement action. Another seeks to encourage private employers to dissolve any DEI initiatives and programs. The extent to which employers and universities may continue past efforts to have a diverse workforce or student body and provide opportunities to historically underrepresented groups is now in question. We have a team of lawyers who are preparing to advise you depending on the potential application of these Orders to you. We anticipate issuing additional guidance as more information becomes available. For any immediate concerns, you may contact any of the following attorneys for assistance.
