On December 14, Joseph Reese obtained a defense judgment following a two day arbitration of a nursing home malpractice case involving a resident who fell from her bed and was later discovered to have a fractured hip. It was alleged a staff member had improperly transferred and positioned the resident in her bed, and that this caused the resident’s fall. It was further alleged that the hip fracture diagnosed three weeks later had been caused by the fall from the bed but was not timely diagnosed. The nursing home denied these claims and, following an evidentiary hearing, an arbitrator found the resident’s claims were not proven.
