Mike Florie and Joe Miller obtained a defense verdict for a pulmonary and critical care physician in a case alleging negligent evaluation and treatment of acute respiratory failure and hyperkalemia, resulting in death of the patient after transfer from another hospital. The plaintiff alleged that her deceased father received inappropriate treatment by a pulmonary and critical care physician after transfer from an outlying hospital. The defendant and his expert witness testified that, based on the content of the phone call between the referring physician and the receiving pulmonologist regarding a transfer, the standard of care was met by the patient being admitted to regular floor, rather than ICU, and that the standard of care was further met by the ordering of routine lab work, rather than stat lab work. The jury returned defense verdict.
