Florie & McCall Secured Dismissal in Two-Week Wrongful Death Trial in Baldwin County

Mike Florie and John McCall recently secured the dismissal of a certified registered nurse practitioner at the close of all evidence in a recent wrongful death claim tried to verdict in Baldwin County, Alabama. The case, which lasted two weeks and involved the testimony of thirty-three witnesses, concerned a fatal Levemir insulin overdose provided to a patient subsequent to a dictation transcription error made by two foreign and one domestic transcription entity. The transcription error was replicated locally by employees of a Baldwin County hospital on a patient transfer form which accompanied the patient to a skilled nursing facility after discharge. After the dismissal of the nurse practitioner, the jury returned a verdict in the amount of $140 million against the corporate transcription defendants and hospital.
