Will Axon and Todd Huntley recently received a defense verdict in a medical malpractice case tried before Judge Robert Vance in Jefferson County. Will and Todd represented a surgery center in a case alleging failure to monitor a patient during her recovery period following a lumbar epidural steroid injection. The plaintiff’s expert argued the nurses in the recovery area failed to follow internal policies and procedures resulting in a patient fall, a broken shoulder and permanent motor deficits. The defense focused on the thoroughness of the post-operative record, the propriety of the instructions given, and the experience of the nurses at the facility. After four days of trial, the jury returned a defense verdict.
