Sellers and Morris Secure Defense Verdict for OB/GYN in 2-Week Medical Malpractice Trial
Randy Sellers and Ben Morris secured a defense verdict in Walker County on behalf of an OB/GYN. The case involved labor of a baby (now 11 years old) who was severely bradycardic for the final 29 minutes of labor that caused permanent brain injury and cerebral palsy. Plaintiff alleged that the OB/GYN should have performed a c-section instead of a vaginal delivery with forceps. The OB/GYN entered the room at 5:28 in the morning and delivered the baby within 21 minutes. Plaintiff argued that the OB/GYN should have performed a c-section within 10-15 minutes and that would have avoided injury. After a two week trial in which the plaintiff called eight experts and treating physicians, the jury rejected Plaintiff's argument and found that the OB/GYN delivered the baby the fastest route as possible.
