Starnes Davis Florie Attorneys Reese & Sellers Win Seven Day Wrongful Death Trial
Joseph Reese and Randy Sellers recently obtained a defense verdict on behalf of a gastroenterologist following a seven day jury trial in Birmingham. The case involved a patient who suffered a cardio-pulmonary arrest during an endoscopic procedure performed under conscious sedation. The arrest caused permanent brain damage, leading to death several days later. It was alleged that the patient was not a suitable candidate for conscious sedation as a mode of anesthesia and that the physician failed to timely and appropriately respond to signs of medication-induced respiratory depression. After two days of deliberation, the jury returned a verdict in favor of the physician.
