Starnes Davis Florie Attorneys Adams and Umbach Obtained Eleventh Circuit Affirmance of Summary Judgment
Allison Adams and Trip Umbach recently obtained Eleventh Circuit affirmance of summary judgment in favor of their client, a metal processing plant in Alabama. The case involved a former plant worker who alleged Title VII and Section 1981 race discrimination claims with respect to his termination. The plaintiff claimed he was discriminatorily terminated because he was involved in an interracial marriage. Trip and Allison demonstrated on summary judgment that the plaintiff's termination was the result of his long history of safety, attendance, and performance violations and no racial bias accompanied the decision. The district court granted summary judgment and the plaintiff appealed. The Eleventh Circuit affirmed the district court's granting of summary judgment and noted that there was no evidence that the employer's reasons for termination were a pretext for discrimination.
