MacKenzie and Bates Successfully Defend Wrongful Death Med Mal Trial.

On March 18, 2008, Bob MacKenzie and Reed Bates secured a defense verdict in favor of an emergency department physician in the Circuit Court of Jefferson County, Alabama. The seven day trial arose from the death of a 60 year old female who presented to the emergency department early in the morning with concerns that she may be having a heart attack. After being evaluated in the emergency department for one hour and forty minutes, the patient was discharged home with instructions to follow up with her primary care physician for a stress test within the next week. The patient went to her primary care physician later the same day and, unfortunately, suffered a cardiac arrest at the office of her primary care physician. The family claimed the defendant physician breached the standard of care by failing to properly diagnose the patient as suffering from acute coronary syndrome, failing to obtain a cardiology consult, and failing to admit the patient for follow up care. The defense contended the care and treatment provided for the patient was appropriate and met the standard of care. The defense was supported by expert testimony and the jury returned a verdict in favor of the physician.
