Starnes Receives Order of Dismissal for Alabama Municipality
Bent Owens and Phil Piggott recently received an Order of Dismissal in favor of an Alabama Municipality, in an action that had been filed by an out-of-state advertising sign company seeking non-commercial billboards within the City limits. The sign company had previously sought commercial billboard message signs in the City, and those had been successfully defended at the federal district court level. The out-of-state advertising company has repeatedly attempted to establish an Alabama billboard foothold, which to date has been successfully fought back. After being denied commercial billboard applications, the same sign company filed a subsequent action in state court seeking non-commercial message billboards. The lawsuit seeking non-commercial applications was recently dismissed by Judge Helen Shores Lee in the Circuit Court of Jefferson County.
