City of Atmore granted dismissal in outdoor advertising case.
Judge Callie Granade of the U.S. District Court for the Southern District of Alabama recently granted in part a Motion to Dismiss filed by Bent Owens, Phil Piggott, Christian Hines and Trey Wells in an outdoor advertising sign matter. The Plaintiff challenged the City of Atmore sign ordinance in its entirety on Constitutional grounds in an effort to rebuild damaged signs and erect new signs within the City. The Court dismissed the majority of the Plaintiff's claims on the basis that the over breadth doctrine did not relieve the Plaintiff of its burden under Article III to demonstrate Constitutional standing. This is a substantial victory in the face of increasing attacks on municipal ordinances throughout the country by outdoor advertising companies.
