Florie and Miller obtain defense verdict in pediatric case.
Mike Florie and Joe Miller obtained a defense verdict for a pediatric anesthesiologist in a case involving an elective tonsillectomy which resulted in brain damage to a five year old girl and death several years later. The patient experienced laryngospasm, bronchospasm and airway problems in the operating room at the induction of anesthesia. Appropriate efforts to establish an airway were attempted. Unfortunately, the patient went a sufficient period of time without air to result in permanent brain damage. The trial lasted over a week. The jury returned a defense verdict in favor of the physician.
The defense was able to prove that the nurses performed an appropriate history and examination. The defense was further able to prove that the patient was continuously monitored throughout the procedure. Additionally, the defense was able to prove that nothing the nurses did or failed to do in their care and treatment of the patient caused the patient's death. The jury returned a defense verdict in favor of the hospital.
