Alabama Supreme Court Affirms Summary Judgment for Drummond Obtained by Davis and Piggott

On March 7, 2008, the Supreme Court of Alabama upheld Summary Judgment to Tony Davis and Phil Piggott in favor of Drummond Company, Inc., in a seven-year case arising from disputes over leases and agreements that went back to the late 1960’s. Alleged claims against the defendant included a breach of contract, fraudulent suppression, and monetary damages. The Alabama Supreme Court found that the defendant had not breached any contract and/or agreement and therefore could not be held liable for any claimed damages. The court also found the fraud claims inadmissible due to the fact that there was no breach of contract.
