Butler & Stevens obtain defense verdict in the Circuit Court of Baldwin County.
Warren Butler and Scott Stevens obtained a defense verdict for the Board of Directors of a condominium association in a 3-day trial held in the Circuit Court of Baldwin County. The case involved alleged breach of fiduciary duty and negligence on behalf of the defendant Board of Directors for allegedly violating the Declaration of Condominium with regard to failure to procure adequate insurance, failure to properly reconstruct the complex, and improper distribution of insurance monies after the condominium was destroyed in Hurricane Ivan. The defense was able to show that the Board complied with the Declarations and Bylaws to the best of their ability after Hurricane Ivan, and the jury returned a defense verdict in favor of the Board of Directors.
